Bernalillo County Metropolitan Court

The Bernalillo County Metropolitan Court (Metro Court) is presently the only one of its kind in New Mexico.  Metro courts have generally the same jurisdiction as a combined magistrate and municipal court.

Preamble: An independent and honorable judiciary is indispensable to justice in our society. The provisions of this Code should be construed and applied to further that objective.

 

21-001. Definitions

21-100. A judge shall uphold the integrity and independence of the judiciary

21-200. A judge shall avoid impropriety and the appearance of impropriety in all the judge's activities

21-300. A judge shall perform the duties of office impartially and diligently

21-400. Disqualification

21-500. A judge shall so conduct the judge's extra-judicial activities as to minimize the risk of conflict with judicial obligations

Court of Appeals

 

The Court of Appeals is the intermediate appellate court in the state of New Mexico.  It sits between district courts and certain administrative agencies, which are below it, and the New Mexico Supreme Court, which is above it. Its jurisdiction covers the entire state.  The Court of Appeals currently reviews appeals in all cases, except criminal cases involving sentences of death or life imprisonment, appeals from the Public Regulation Commission, and cases involving habeas corpus.  The Court's caseload is about 900 cases per year.

State Bar of New Mexico

The State Bar of New Mexico (State Bar) is a professional membership organization of attorneys licensed to practice law in the State of New Mexico.  Established in 1886, the State Bar currently (02/2008) has over 8,144 members.  It was incorporated under the laws of the State of New Mexico in 1978.  Prior to that, the State Bar operated as an agency of the Supreme Court of the State of New Mexico, established by State Statute on March 17, 1925.  It is now independent of the court system.

Supreme Court

 

The New Mexico Supreme Court (NMSC) is the highest judicial authority of the state.  NMSC's website provides public access to court opinions originating from the supreme court as well as the New Mexico Court of Appeals.  Other resources include public access to various legal forms, and news and announcements of interest to the New Mexico judicial and legal communities.

Second Judicial District

This is a state court of general jurisdiction serving Bernalillo County.  Like other district courts, this one has general jurisdiction for adjudicating all felony offenses, all domestic relations matters, civil litigation, such as personal and property damage suits, probate matters, property actions, mental illness hearings, processing of all juveniles referred to the court, and other actions where citizens may seek judicial relief. The district court has supervisory control and appellate jurisdiction over inferior courts and tribunals.

Third Judicial District

The Third Judicial District Court is a state court of general jurisdiction located in Las Cruces, New Mexico. The Third Judicial District consists of the same geographic area as Dona Ana County.

 

The district court has jurisdiction over criminal cases, domestic relations (divorce, child support and custody, domestic violence), probate cases, children's court (abuse and neglect of children, juvenile delinquency, adoptions) and all general civil cases (auto accidents, contract disputes, real property disputes, violation of civil rights).
